The Rules and Risks of Mortgage Advertising Have Changed in 2008
I learned that there are a lot of basic rules that I needed to be aware of such as always listing the APR in my ads as required by Truth in Lending Act and Regulation Z.. Many states also had rules restricting simulated checks, ads that appear to come from a government agency, and ads that refer to the borrower's current loan amount and lender. Those were not so hard to get my arms around once I knew what the rules were.
A Lot More to Pay Attention to Than Just Reg-Z APR Rules
What I did not know was that you also have to be very careful of the statements and claims you are making in your mortgage ads. It seemed that your could always get away with stretching the facts a bit or leaving out some of the important details from your ads. I watched the news and regulatory bulletins and began to notice that companies were getting sued, and were getting fined for misleading and deceptive advertisements and failure to follow other specific requirements. I also noticed in recent years (particularly 2007 and 2008) that the rules are changing and you have to be even more careful about what claims and statements you are making in your ads.
As a Compliance Officer, my job was to make sure that our company would not get sued or in trouble with state and federal regulators for anything that appeared in our mortgage ads.
